Warranty

Western Weather Group will pass all warranties issued by the equipment manufacturers to the Buyer at the time of the delivery of the instrumentation. All instrumentation returned under warranty shall be returned directly to Western Weather Group. Western Weather Group will work with the manufacturer to repair or replace any defects in materials and workmanship under normal use and service for twelve (12) months from the date the equipment is shipped to the Buyer, subject to the following conditions: Western Weather Group's obligation under this warranty is limited to repairing or replacing (at the manufacturer's option) products which have been returned prepaid to Western Weather Group. Western Weather Group will return warranted equipment by surface carrier prepaid unless delivery is outside the continental U.S. In such case, where delivery is outside the continental U.S. , return shipping charges will be billed to the Buyer. This warranty shall not apply to any products which have been subjected to modification, misuse, neglect, accidents of nature, or shipping damage. Batteries are not warranted. Under no circumstances will Western Weather Group reimburse the claimant for costs incurred in removing and/or reinstalling equipment. This warranty and Western Weather Group's obligation thereunder, is in lieu of all other warranties, expressed or implied, including warranties of suitability and fitness for a particular purpose. Western Weather Group is not liable for consequential damages.

Western Weather Group does not warrant that the software will meet the end user requirements or that the software or documentation is error free or that the operation of the software will be uninterrupted. The warranty does not cover any diskette or documentation that has been damaged or abused. The software warranty does not cover any software that has been altered or changed in any way by anyone other than Western Weather Group. Western Weather Group is not responsible for problems caused by computer hardware, computer operating systems or the use of Western Weather Group’s software with non-Western Weather Group software. All warranties of merchantability and fitness for a particular purpose are disclaimed and excluded. Western Weather Group shall not in any case be liable for special, incidental, consequential, indirect, or other similar damages even if Western Weather Group has been advised of the possibility of such damages. Western Weather Group is not responsible for any costs incurred as a result of lost profits or revenue, loss of use of the software, loss of data, cost of re-creating lost data, the cost of any substitute program, claims by any party other than user, or for other similar costs. Purchaser's sole and exclusive remedy is set forth in this limited warranty. Western Weather Group’s aggregate liability arising from or relating to this agreement or the software or documentation (regardless of the form of action; E.G., contract, tort, computer malpractice, fraud and/or otherwise) is limited to the purchase price paid by the purchaser.

Western Weather Group shall not be held responsible for any failure or malfunction in power or communications. Western Weather Group makes no express or implied warranties, guarantees or affirmations that weather information will occur or has occurred as the reports, forecasts, data, or information state, represent or depict and it shall have no responsibility or liability whatsoever to Client or any other person or entity, parties and non-parties alike, for any inconsistency, inaccuracy, or omission for weather or events predicted or depicted, reported, occurring or occurred. Western Weather Group, makes no warranties hereunder and this disclaimer of warranties includes, but is not limited to, the warranties of merchantability and fitness for a particular purpose. Client is advised and informed that the government issues official watches, warnings, advisories, bulletins and other communications client should keep advised of same. Affiliate and third parties are solely responsible for action or lack of action taken to preserve life or property.

Weather alerts and frost alarms are provided for our customers who desire this feature from one of the automated weather stations. Western Weather Group shall not be held responsible for any failure or malfunction of an automated weather station weather alert or frost alarm. The use of an automated weather station weather alert/frost alarm is at the user’s sole discretion and responsibility. Western Weather Group is not responsible for any costs incurred as a result of any damage, lost profits or revenue.
